BREAKING: DELTA COURT GRANTS INTERIM INJUNCTION, BLOCKS NIGERIA POLICE FROM ENFORCING TINTED GLASS PERMIT POLICY

The Delta State High Court sitting in Orerokpe has issued an interim injunction restraining the Nigeria Police Force from implementing or enforcing the tinted glass permit policy scheduled to commence on January 2, 2026.

The order was delivered on Wednesday, December 17, 2025, by Justice Joe Egwu in a suit filed by Mr. Israel Joe against the Inspector General of Police, the Nigeria Police Force, and the Commissioner of Police, Delta State Command.

In the case, marked Suit No: HOR/FHR/M/31/2025, the applicant sought a court order preventing the police from enforcing the tinted glass permit policy pending the hearing and determination of the substantive suit. The applicant further requested protection against any action by the police that could infringe on the constitutional rights of citizens, including dignity, privacy, freedom of movement, and property ownership, under the guise of implementing the policy.

In granting the motion ex parte, the court upheld all prayers of the applicant, restraining the police from “implementing, enforcing, or further implementing” the tinted glass permit policy until the substantive application is heard. Justice Egwu also ordered that the respondents must not stop, harass, arrest, detain, extort, or otherwise interfere with the constitutional rights of the applicant or other motorists.

Additionally, the court barred the respondents from using the Parkway Projects account, described in the application as a private account, for any government transactions pending the resolution of the case.

The court also approved substituted service on the first and second respondents via the third respondent, the Commissioner of Police, Delta State Command at the police headquarters in Asaba, declaring such service proper and sufficient.

Although Mr. Israel Joe was not present in court, he was represented by a legal team led by SAN Kunle Edun, alongside Ikechukwu Ogbonna Esq., E.O. Onoriode Esq., S.C. Okporgu Esq., T.L. Doigboghie Esq., A.H. Okifo Esq., Sir F.O. Yekovie, and J.K. Ezugwu Esq.

After hearing from counsel, the court granted the ex parte motion dated December 17, 2025, as prayed. The hearing of the motion on notice has been scheduled for December 24, 2025.

The interim orders, sealed by the court, remain in effect until the substantive suit is determined.
