Former Kaduna State Governor Nasir Ahmad El-Rufai and his family have served a formal legal demand on the Independent Corrupt Practices and Other Related Offences Commission (ICPC), its Chairman, and certain officers, seeking N15.6 billion in damages for alleged unlawful detention, defamation, and violation of fundamental rights.

The demand, contained in a letter dated March 4, 2026, follows El-Rufai’s recent arrest and detention by the ICPC, as well as a controversial press statement issued by the commission on March 2, 2026. In that statement, the ICPC claimed to have recovered “wiretapping equipment” during a search of El-Rufai’s residence.

El-Rufai’s legal team described the allegation as “false, misleading, and defamatory,” asserting that it has caused severe reputational harm to the former governor and his family. The notice accuses the ICPC of multiple infringements on fundamental rights, including unlawful detention and abuse of office.

The total claim of N15.6 billion breaks down as follows:
– N5 billion in compensatory damages
– N5 billion in exemplary and punitive damages (to deter similar conduct by public officials)
– N5 billion in aggravated damages
– N500 million for injurious falsehood
– N100 million to cover legal costs

The legal team has issued a 24-hour ultimatum for full compliance with the demands. Failure to meet the deadline, they warned, will result in immediate legal escalation, including:
– Filing contempt of court proceedings against the ICPC Chairman at the Federal High Court
– Accelerating pending fundamental rights enforcement and bail applications at the FCT High Court
– Initiating civil suits for malicious prosecution, false imprisonment, defamation, and abuse of office

The lawyers also threatened to report what they allege is the forgery of a remand order for criminal investigation to relevant authorities, petition the FCT Judicial Service Commission for disciplinary action against the involved magistrate, and file a formal complaint with the African Commission on Human and Peoples’ Rights over alleged grave violations of fundamental rights by a state institution.

As of the latest update on March 5, 2026, the ICPC had not issued any official response to the demand letter.
The development marks the latest twist in the ongoing legal and public controversy surrounding El-Rufai’s interactions with anti-graft agencies, following earlier reports of his detention and health concerns while in custody.
