BREAKING: Court threatens to foreclose Nnamdi Kanu’s case if he fails to open defence

A Federal High Court in Abuja has warned that it will close the defence of Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra (IPOB), if he fails to open his defence in his terrorism trial on November 5.

Justice James Omotosho issued the warning on Tuesday after Kanu, for the fourth time, failed to begin his defence following the prosecution’s closure of its case and the court’s dismissal of his no-case submission.

 

At the hearing, Kanu—who is representing himself—said he had filed a motion and affidavit instead of the final written address ordered by the court, insisting that no valid charge exists against him and demanding his release.

 

Prosecuting counsel Adegboyega Awomolo (SAN) described Kanu’s filings as improper and accused him of delaying the trial, urging the court to treat them as his final address and proceed to judgment.

However, Justice Omotosho ruled that Kanu’s documents were properly filed and allowed him more time to consult legal counsel. The case was adjourned to November 5, when Kanu must open his defence or forfeit the right to do so.

 

Kanu faces terrorism charges linked to IPOB’s separatist activities. Arrested in 2015 and re-arrested in 2021 after jumping bail, he remains in the custody of the Department of State Services (DSS).
