EFCC MOVES TO OVERTURN ₦10 MILLION DAMAGES AWARDED TO EX-MINISTER AGUNLOYE

The Economic and Financial Crimes Commission (EFCC) has appealed the judgment of a Federal Capital Territory (FCT) High Court that ordered it to pay ₦10 million in damages to former Minister of Power, Olu Agunloye, over a defamatory social media publication.

The notice of appeal was filed at the Court of Appeal in Abuja on Friday, July 10, 2026, by the EFCC’s legal counsel, Wahab Shittu (SAN).

The appeal challenges the entire judgment delivered by Justice Peter Kekemeke of the FCT High Court on July 8, 2026, in the suit filed by Agunloye over allegations linking him to the alleged $6 billion Mambilla Power Project fraud.

According to the appeal, the anti-graft agency is dissatisfied with the trial court’s decision and has asked the appellate court to overturn the judgment.

The EFCC based its appeal on 11 grounds and is seeking orders setting aside the High Court’s ruling, dismissing Agunloye’s claims in their entirety, and granting any other relief the Court of Appeal considers appropriate.

Justice Kekemeke had ruled that the EFCC’s social media publication about Agunloye was false, defamatory, and damaging to his reputation. The court subsequently awarded the former minister ₦10 million in damages.

In addition to the appeal, the EFCC has also filed an application seeking a stay of execution of the High Court’s judgment pending the determination of the appeal.

As of the time of filing, no date has been scheduled for the hearing of the appeal.
