ADC TO INEC CHAIR: YOU’RE ACTING IN CONTEMPT OF COURT

The African Democratic Congress (ADC) has refuted claims that its planned congresses and national convention could breach court directives, describing the position as a misrepresentation of the law.

In a statement, the party argued that the Independent National Electoral Commission (INEC) has overstepped its supervisory role by suggesting that internal party activities violate court orders. ADC stressed that no court has explicitly prohibited the party from holding its congresses and convention.

Responding to warnings that proceeding could conflict with existing judicial directives, the ADC said INEC’s interpretation of status quo orders is selective and legally flawed, noting that such orders are meant to protect subjects of litigation, not halt lawful party operations.

“The determination of the status quo is the court’s responsibility, not INEC’s,” the party said, emphasizing that its activities, conducted in line with the Electoral Act, remain valid even amid pending judicial proceedings.

The ADC also rejected suggestions that the absence of INEC oversight undermines its processes, maintaining that all party activities are lawful. While acknowledging internal disagreements, the party affirmed that these do not suspend its constitutional or democratic rights.

Reaffirming its commitment to due process, the ADC stated it would proceed with its congresses and national convention while urging INEC to operate within its constitutional boundaries.
