On February 10, 2025, Justice Binta Nyako of the Federal High Court in Abuja adjourned the trial of Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), indefinitely. This decision followed Kanu’s assertion that Justice Nyako lacked the jurisdiction to preside over his case, citing her previous recusal on September 24, 2024, after he expressed a lack of confidence in her impartiality.
Despite her earlier recusal, the Chief Judge of the Federal High Court, Justice John Tsoho, reassigned the case back to Justice Nyako, emphasizing that Kanu’s request for her recusal should have been formally submitted through a motion on notice.
In the recent court session, Kanu vocally challenged the court’s authority, stating, “I don’t recognise the authority of this court to preside over my case. Everything you said here is meaningless to me.” He further contended that the Chief Judge’s directive could not override the court’s previous order of recusal.
Kanu’s legal team has maintained that Justice Nyako’s recusal remains valid and has called for the case to be transferred to another judge or relocated to a Federal High Court in the South-East.
