EL-RUFAI FACES TWO-YEAR JAIL FOR ALLEGED CYBERCRIME OFFENCES

Former Kaduna State Governor, Nasir El-Rufai, could face up to two years in prison if convicted of cybercrime offenses he has been charged with.

The Directorate of State Service (DSS) filed a three-count criminal charge against El-Rufai, alleging unlawful interception of the National Security Adviser Nuhu Ribadu’s phone communications. The charges, submitted to the Federal High Court in Abuja, reference statements the ex-governor made during a February 13, 2026, television interview, which investigators say suggest knowledge of criminal activity.

Prosecutors claim El-Rufai admitted awareness of the phone interceptions, failed to report those involved, and allegedly benefited from technical systems that endangered national security. The counts include:

  1. Admitting to unlawful interception of phone communications.

  2. Knowing individuals who committed the interceptions but failing to report them.

  3. Using technical systems to compromise public safety and national security.

Under the Cybercrimes (Prohibition, Prevention, etc) Amendment Act, 2024, conviction can result in a two-year jail term, a fine of N5 million, or both. The Nigerian Communications Act 2003 also stipulates fines or imprisonment for related offenses.

EFCC Detention over Alleged Financial Mismanagement

Following the DSS charge, El-Rufai was detained by the Economic and Financial Crimes Commission (EFCC) in Abuja after an eight-hour interrogation. Investigators are examining allegations from a Kaduna State House of Assembly report that suggests mismanagement of up to N432 billion in state funds during his tenure from 2015 to 2023.

The EFCC is specifically seeking explanations for over N21 billion, including funds linked to the stalled Kaduna light rail project. Investigators are probing claims of fund diversion, money laundering, and accumulation of unjustified domestic and foreign debts.

Protests and Public Reactions

El-Rufai’s visit to EFCC headquarters drew both supporters and critics. Demonstrators carried placards demanding accountability, while others accused authorities of political targeting. EFCC officials assured the public that investigations would proceed professionally and in accordance with due process.

In Kaduna, protesters gathered at the State House of Assembly, seeking updates on the probe into his administration. Lawmakers emphasized that no individual, regardless of position, is exempt from scrutiny.

El-Rufai has also been linked to other controversies, including disputes over the importation of a chemical from Poland and interactions with national security agencies. He is expected to appear before the Independent Corrupt Practices and Other Offences Commission (ICPC) regarding separate allegations.
